1. About Us and Acceptance of These Terms
Gen AI X App ("the Service") is operated by X00APP100X LTD, a company registered in England and Wales under company number 16931020, with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom ("we", "us", "our", "the Company").
By creating an account, accessing, or using the Service, you ("you", "the User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Definitions
The Gen AI X App platform available at genaixapp.com and any related applications, APIs, or tools we provide.
The registered user account required to access most features of the Service.
A paid, recurring plan (currently "Starter" or "Pro", or any successor plans) as described on our Pricing page at genaixapp.com/pricing, which sets out current prices, billing frequency, and credit allowances.
Credits are internal usage units deducted from your Account balance for metered actions performed on the Service (AI generation, iteration, compilation, auto-fix, or evaluation events) according to rates shown on our Pricing page.
Any application, code, files, or output produced by the Service in response to your prompts. "Content" means anything you submit to the Service, including prompts, text, images, and files.
3. Eligibility & 4. Your Account
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you confirm that you meet these requirements and that all information you provide to us is accurate and complete.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.
- You must notify us promptly of any unauthorised use of your Account.
- You may only maintain one active Subscription Plan at a time.
- We may suspend or terminate your Account as set out in Section 14.
5. Description of the Service
The Service uses AI (via Google's Gemini models) to generate mobile application code from your prompts, compiles that code using a remote build service to produce a live preview, and allows you to iterate on, download (as a ZIP archive), or synchronise the resulting Generated App to a connected GitHub repository.
6. Subscription Plans, Billing, and Credits
6.1 Plans and Pricing
Current Subscription Plans, prices, billing frequency, and Credit allowances are set out on our Pricing page (genaixapp.com/pricing). We do not offer a free trial. By subscribing, you authorise us (via our payment processor, Stripe) to charge your payment method on a recurring basis at the stated frequency until you cancel.
6.2 Price and Credit-cost Changes
We may change plan prices, allowances, or Credit costs of Metered Actions from time to time. We will give reasonable advance notice of material changes before they take effect for your next billing period.
6.3 Credits & Failed-Build Refunds
- Credits are deducted for each Metered Action at the rate shown on our Pricing page at the time of the action.
- Credits included with your Subscription Plan reset at the start of each billing period. Unused Credits do not roll over and expire at the end of each billing period.
- Credits have no cash value and cannot be transferred, sold, or gifted to another user or Account.
- Failed-build refund: If the final compilation of a given prompt fails, Credits charged for compilation and auto-fix actions within that prompt are automatically refunded. Credits charged for AI generation, iteration, or evaluation actions are not refunded.
- We may apply a maximum Credit spend per prompt ("per-prompt cap") to manage platform stability.
6.4 Upgrades and Downgrades
Upgrading your Subscription Plan takes effect immediately: your billing period restarts, you are charged the new plan's price (with unused previous payment credited pro rata by Stripe), and your Credit balance is set to the new allowance. Any unused previous Credits are forfeited. Downgrading takes effect at the end of your current period.
6.5 Cancellation & Statutory Cancellation Waiver
You may cancel your Subscription Plan at any time via the Stripe billing portal linked from your Account. Cancellation takes effect at the end of your current paid billing period.
Statutory cancellation right: Under the Consumer Contracts Regulations 2013, you ordinarily have a 14-day cancellation right. Because the Service begins performance immediately upon subscribing, by subscribing you expressly request immediate performance and acknowledge that you will lose your right to cancel and receive a refund once performance has begun (Regulation 36/37).
6.6 One-time Credit Packs
- Eligibility: One-time Credit Packs are available only to users with an active Subscription Plan (Starter or Pro) at the time of purchase. Accounts with no active subscription, a canceled subscription, or a past-due status are not eligible to purchase packs.
- Non-refundable: Credit packs are a one-time, non-refundable purchase immediately upon completion of transaction, do not automatically renew, and are not a Subscription Plan.
- 12-Month Expiry: Credits from a Credit Pack expire 12 months from the date of purchase, independent of the weekly subscription cycle. Expired pack credits are automatically forfeited.
- Spend Order: Pack Credits are consumed only after a user's current weekly subscription Credits for that billing period are exhausted. If a user holds multiple pack purchases, deductions draw from the batch with the nearest expiry date first.
7. Future Regulation & 8. Acceptable Use
We intend to comply with forthcoming UK legislation (the Digital Markets, Competition and Consumers Act 2024), providing renewal reminder notices and simplified cancellation.
You must not use the Service to:
- Generate illegal content, malware, attack tools, or content intended to deceive or defraud.
- Attempt to circumvent, manipulate, or abuse Credit metering, rate limits, or billing systems.
- Reverse-engineer, scrape, or resell access to the Service without our written permission.
- Interfere with the proper operation of the AI, compilation, or infrastructure components.
9. AI-Generated Content — Important Disclaimers
You are solely responsible for reviewing, testing, and validating any Generated App before relying on, publishing, deploying, or distributing it.
- AI-generated code may contain errors, security vulnerabilities, or unintended behaviour, even where a compilation succeeds.
- We do not warrant that any Generated App will be fit for any particular purpose, secure, bug-free, or compliant with app store requirements (Apple App Store, Google Play) or applicable laws.
- You are responsible for ensuring that any Generated App and its end-user data complies with applicable data protection and consumer laws.
- The underlying AI models are provided by Google under Google's own terms; you are responsible for complying with those terms where applicable.
9.1 User-Provided Environment Variables & Third-Party API Keys
You are solely responsible for the custody, confidentiality, security, and use of any third-party credentials, tokens, or API keys (including OpenAI, Anthropic, Gemini, Groq, Supabase, Stripe, and others) configured in the Service.
- Complete Disclaimer of Liability for Compromise, Hacking & Loss: To the maximum extent permitted by law, X00APP100X LTD, its directors, employees, and affiliates shall have zero liability for any unauthorized access, interception, decryption, leak, security breach, reverse-engineering, hacking incident, compromise, or misuse of any credentials entered by you, whether resulting from client-side extraction, binary decompilation, web inspector analysis, repository misconfiguration, or external exploitation.
- Third-Party Charges & Financial Losses: Third-party APIs may incur separate usage, inference, overage, or subscription fees. The Company has no control over and accepts zero liability for third-party charges, unauthorized API calls, unexpected billings, account suspensions, rate limiting, or financial losses incurred on your external accounts.
- Client-Side Architecture Risk: You acknowledge that compiling secret keys into client-side mobile or web binaries carries inherent extraction risks. While the Service provides vault isolation, GitHub .gitignore safeguards, and edge proxy utilities, you bear full responsibility for how you configure, export, deploy, or distribute your applications.
- Full Indemnification: You agree to defend, indemnify, and hold harmless X00APP100X LTD against any claims, losses, liabilities, costs, or expenses (including legal fees) arising from your provision, storage, or transmission of third-party API credentials, or any violation of third-party platform terms.
10. Intellectual Property
- We (and our licensors) own all rights in the Service itself, including software, design, branding, and underlying technology.
- Subject to third-party rights (including Google Gemini API terms), you retain ownership of prompts you submit and resulting Generated App code, to the extent capable of being owned under applicable law.
- You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and transmit your Content solely as necessary to provide, maintain, secure, and improve the Service.
11. Third Parties, 12. Limitation of Liability & 13. Indemnity
The Service integrates with Google (Firebase, GCP, Gemini API), Stripe (payments), GitHub, and optional third-party API providers configured by you. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or statutory consumer rights under the Consumer Rights Act 2015.
Liability Cap: Our total aggregate liability arising out of or in connection with these Terms or the Service is strictly limited to the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim.
Indemnity: You agree to indemnify and hold us harmless from claims arising from your breach of these Terms, misuse of the Service, third-party API key exposure or abuse, or any Generated App you publish or deploy.
14. Termination, 15. Changes & 16. Governing Law
We may suspend or terminate accounts for breach of Terms, suspected fraud, or abuse. These Terms are governed exclusively by the laws of England and Wales, with exclusive jurisdiction in the courts of England and Wales.
